Warren Timberlake & wife to John L. Cochran

This Indenture made this thirty first day of January in the year of our Lord one thousand eight hundred & thirty four between Warren Timberlake & Susan Timberlake his wife of Morgan County State of Ohio of the first part and John L. Cochran of Muskingum County State aforesaid of the other part. Witnessith that for & in consideration of the sum of four hundred dollars to them in hand paid by the said John L. Cochran, the receipt where of is hereby acknowledged, the said Warren Timberlake & Susan his wife hath granted, bargain... sold and conveyed and by these presents doth grant, bargain, sell, and convey unto the said John L. Cochran his heirs and assigns forever, all that tract or parcel of land situate & lying in the County of Morgan, State of Ohio ____the South half of the South East quarter of Section No. nine Township No. ten Range No. eleven containing eighty three acres, be the same more or less together with all the privileges and appurtenances to the same in any wise belonging. To have & to hold the same to the said John L. Cochran his heirs and assigns forever, and the said Warren Timberlake for himself his heirs executors and administrators, covenants with the said John L. Cochran his heirs & assigns that he the said Warren Timberlake is lawfully seized in fee of the aforesaid premises, that he has good right to sell & convey the same to the said John L. Cochran and that he will and his heirs executors and administrators shall warrant and defend the same to the said John L. Cochran his heirs and assigns forever against the lawfull claims and _____ of all persons. Provided nevertheless that if the said Warren Timberlake his heirs executors administrators or assigns shall pay to the said John L. Cochran his executors administrators or assigns the said sum of four hundred dollars with lawful interest on or before the thirty first day of January one thousand eight hundred & thirty eight (ie) one hundred each year according to the stipulations contained in four notes of hand for one hundred dollars each bearing even date with these presents given by the same Warren Timberlake to the said John L. Cochran then this deed and also the aforesaid notes of hand shall both be null & void to all intents & purposes otherwise shall remain absolute.
